Kansas State Background Check Laws
Kansas has a state law requiring employers to inform job applicants, in writing, about the specific nature of the information that will be requested in a background check.
For positions with a salary below $20,000, criminal records reported in the background check are limited to a seven-year period. The employer must provide this notification to the applicant within three days of requesting the report.
Additionally, if an employer decides to deny employment based on information in a consumer report, they must inform the applicant in writing. This notice should include the name and address of the Consumer Reporting Agency (CRA) that prepared the report and instructions on how to obtain additional copies.
Kansas does not have a statewide Ban-the-Box or Fair Chance law.
Kansas law permits individuals with certain criminal convictions to petition for expungement. If granted, the expunged records are treated as if the individual was never arrested or convicted, and they are not required to disclose these offenses to potential employers.
